1. Purpose. These Terms and Conditions outline the circumstances under which fees paid by candidates seeking employment opportunities abroad may be refunded by Execuget Consult Ltd. They aim to ensure transparency, fairness, and compliance with applicable labour migration and consumer protection laws.
2. Scope. These Terms and Conditions apply to all candidates who have paid fees to the Company in connection with overseas recruitment, job placement, documentation processing, training, medical examinations, visa applications, travel arrangements, or related services.
3. Non-Refundable Fees. The following costs are generally non-refundable once incurred by the Company or paid to third parties on behalf of the candidate: medical examination fees, visa application fees, passport processing fees, Police Clearance Certificate fees, document authentication and attestation fees, air ticket costs already purchased, insurance premiums already paid, training and certification fees already undertaken, bank charges and transaction fees, and any other third-party costs already incurred on behalf of the candidate.
4. Refund Scenarios
A. Candidate Withdraws Before Processing Begins. Up to 90% refund of fees paid may be granted; administrative charges of up to 10% may be deducted.
B. Candidate Withdraws After Processing Has Commenced. Refunds are limited to the balance remaining after deducting all expenses already incurred by the Company and third parties, plus a 10% administrative fee.
C. Employer Cancels Job Opportunity. The Company shall refund all recoverable amounts received, less non-refundable third-party expenses already incurred and a 10% administrative fee.
D. Visa Rejection. Fees paid to embassies, visa centres, medical facilities, insurance providers, and other third parties shall not be refunded. Any unused balance shall be refunded after deducting a 10% administrative fee and processing costs.
E. Candidate Fails Medical Examination. Medical fees and other costs already incurred shall not be refunded. Any remaining balance shall be refunded after deducting applicable expenses and a 10% administrative fee.
F. Candidate Provides False Information. No refund shall be payable where the candidate submits fraudulent documents, provides false information, or is disqualified due to criminal records, immigration restrictions, or misrepresentation.
G. Candidate Refuses Deployment. The Company reserves the right to retain all fees necessary to recover costs incurred. Any remaining balance, if any, shall be refunded after deductions, including a 10% administrative fee.
5. Refund Request Procedure. A candidate seeking a refund must submit a written refund request, provide proof of payment, attach supporting documentation where applicable, and provide bank account details for refund processing.
6. Refund Processing Period. Approved refunds shall be processed within fourteen (14) working days from the date of approval, subject to reconciliation of expenses and verification of supporting documents.
7. Method of Refund. Refunds shall be made through bank transfer or mobile money transfer, and only to the original payer unless otherwise authorised in writing.
8. Dispute Resolution. Any dispute arising from these Terms and Conditions shall first be addressed through internal review by the Company. Where unresolved, the matter may be referred to the relevant labour migration authority, dispute resolution body, or courts of competent jurisdiction in Kenya.
9. Amendment of Terms. The Company reserves the right to amend these Terms and Conditions from time to time in accordance with applicable laws, regulations, and business requirements.
